Terms of Service

1. Acceptance of terms

By accessing or using Presence ("the Service"), operated by Miikana Co. ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of service

Presence is a gift coordination platform that allows users to create wishlists, organise social circles, coordinate gift purchases, and track occasions such as birthdays and anniversaries. The Service is available via our iOS application and web application at presence-gifting.miikanaco.com.

3. Eligibility

You must be at least 16 years of age to use Presence. By using the Service, you represent that you meet this requirement. We do not knowingly allow users under 16.

4. Your account

You are responsible for maintaining the security of your account and all activity that occurs under it. We use passwordless email authentication (magic links) to keep your account secure. Notify us immediately at hello@miikanaco.com if you suspect unauthorised access.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Post content that is misleading, defamatory, obscene, or infringes on third-party rights.
• Attempt to gain unauthorised access to other users' data.
• Use automated tools, bots, or scrapers to interact with the Service.
• Interfere with or disrupt the integrity of the Service.
• Misrepresent your identity or affiliation.

6. User content

You retain ownership of content you create on Presence (wishlists, profile information, circle names, etc.). By submitting content, you grant us a limited, non-exclusive licence to store and display that content to provide the Service.

You are solely responsible for the content you submit. We do not endorse any user content and are not responsible for it.

7. Affiliate links

Presence participates in affiliate marketing programmes. Product links within the Service may be affiliate links. When you click these links and make a purchase, Presence may receive a commission at no extra cost to you. We use Sovrn Commerce as our affiliate partner. All affiliate relationships are disclosed in our Privacy Policy. Affiliate commissions do not influence the content users add to their wishlists.

8. Third-party links

Users may add links to third-party products and websites. We are not responsible for the content, privacy practices, or terms of those third-party sites. Clicking third-party links is at your own risk.

9. Intellectual property

The Presence name, logo, and all Service content created by us (excluding user content) are owned by Miikana Co. and protected by applicable intellectual property laws. You may not use our branding without written permission.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any defects will be corrected. Product availability, pricing, and descriptions are controlled by third-party merchants and may change without notice.

11. Limitation of liability

To the fullest extent permitted by law, Miikana Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts of the United States.
